What is the name of your state? california
i filed for divorce through a paralegal and the papers were sent by mail to my husband. i was told by the court that my husband returned to them the form that said that he had received the papers. he has not sent anything else to them. can the divorce go through even if he does not sign the papers because he aknowledged that he did receive them?

My response:

Yes, your dissolution will "go through". To avoid a default, respondent must take timely responsive action. That usually will mean filing an appropriate response within 30 days of service of the summons and petition; i.e., from the date he signed the proof of service.

But, if he fails to respond to the Petition, and once the initial 30 days has expired, all you need do is to file your "Request for Entry of Default," wait for the expiration of your mandatory waiting period of 6 months from the date he signed the proof of service, then file your "Request for Judgment of Dissolution and Notice of Entry of Judgment."

Voila, as soon as the judge signs and serves the order on you, you are then "divorced."
