What is the name of your state (only U.S. law)? Al


I am still married to someone I want a divorce from. The problems are: he says we are divorced when the courts say we're still married. He is basically refusing to divorce me so he can have control of me. We have a daughter together, his sister has guardianship so custoday is not an issue. We live in different states. Neither one of us can afford a lawyer. So what can I do and how would I do it? I know if I sent him divorce papers more likely he won't sign them. He says he doesn't want to be married anymore either. :mad:What is the name of your state (only U.S. law)?

If you have established residency in Alabama, you should be able to file for divorce. If there is no property settlement involved, you can file on your own. Even if he doesn't show up or sign the paperwork, you can still be awarded divorce by default. However, you must make sure he is properly served.
