What is the name of your state (only U.S. law)? Mississippi
My daughter would like to divorce her husband; she has two children who she does not have custody of at this time; can she file a no contest divorce from her husband?

Well, yes. But if he objects to anything she requests, he can contest it and it will become a contested divorce. Uncontested divorces only work if both parties are in full agreement on the terms.

For example, if she requests custody, odds are pretty good that he would challenge it in the above scenario.
