My wife walked out my house w/infant and she informed me that
she did not want to stay w/me anymore by accusing that she wanted a better family life. Next day I found out that she cheated
me, betrayed me and had an affair w/her co-worker and she moved directly to his house after she left me. I tried my best to
forgive her for what she did to me; only wanted both of us stay
together so our children's mental would not be damaged, but my efforts were not responded. She is filling divorce in attempt to
receive full custody of my children. My situation is as follows:
We lived together 3 years before my first boy was born. Since
my salary is lower than her salary, we both agreed that I stayed
home to take care the boy. So that I quitted my job and do as we
agreed. Few months later, we decided to apply a marriage license
( april 98). and the second daughter was borned (2001). I took
care both of childrens so she can go to work. I owned the house
before I married with her. After she left(she now physically lived
with her co-worker), It forced me to look a job so I and my son (
3yrs old boy) can live. She tooked out all monies from our
join checking account and deposited her salary to her co/worker
checking account. I found the very good job job. My son is now
in school. I pay my own bill now and all expenses for my son.
My question is can the judge awards her full custody? I want to
keep my son and she keeps the daughter. I do not have much
cash to go to the lawyer who is always ask me to put the retainer. Can I find any lawyer can help to fight for my boy custody
withou asking the big retainer? thank you very much.

Find out about legal aid in your state. The court provides legal aid to those who cannot afford lawyers. It is clear from your wife's action that she is no longer interested in you or the marriage. Therefore go ahead and file for divorce and request custody of your son in your divorce coplaint.
