From Illinois: My daughter has been married 11 months and moved out of a recently purchased house, that her and her husband purchased. It is in both of their names. They will be divorcing. He will not allow her in the house and says that he will have her arrested if she takes anything out of the house.

Can she enter the house without his permission and if he has changed the locks, can she break in?

If her name is on the house, he can not keep her from it, nor can he keep her from taking her belongings. If he changed the locks on her, she should get a copt of the title and take a locksmith with her to get her into the house. I would suggest having her take a video camera and record the belongings in the house, so he can't sell or get rid of things before the divorce is settled. This way, she has proof of what they had so she can get whatever percentage she is entitled to. Anything that was hers before the marriage, she can take. He can't stop her.
