What is the name of your state (only U.S. law)? South Carolina. In the state of South Carolina, if I was the one that committed Adultery and want to file for divorce, do I still have live separate from my husband for a year before I file??

Probably. IF SC is one of those states that allows for a quicker "fault" divorce versus a year long separation for a no-fault divorce, then YOU cannot file for a fault divorce, because your husband didn't commit adultery. HE could file for a fault divorce.

Of course, you could move to another state, establish residency there under that state's requirements (usually six months) and then file for a regular no fault divorce....but that would only save you a few months.
