What is the name of your state? CA

Does an American woman living in the United Arab Emirates with her naturalized American husband and children have divorce rights according to US law if husband tries to file for divorce there.

If the husband tries to file for divorce in the UAE? No, US law would not apply.

What if the wife files in the US--her home state?
Is she in the military in UAE? If not then she doesn't have residency in the US still and would have to move here and live for at least six months if not a year depending on her home state.

Residency relationship to Divorce worries and mental illness

Thank you for your reply. It is of course absolutely correct. Problem is that wife has experienced severe mental depression with serious episodes of mental breakdown and believes that returning to her home state would relieve some of the pressure and revive her. She is desperate and fearful of what she might do when in one of these mental states and her husband refuses to acknowledge her very serious condition although the severity of the illness has been explained by both the doctor and other professionals. They have several children(ages 8-19) and she is losing touch with everything because of these deep depressive states she falls victime to at least 5 months out of the year. Of course he does not mind if she "goes home" alone for as long as she likes. But that would not give her any peace of mind or relief from the tension of needing to go back. Her children and family are her life and she would sacrifice for them. So, yes, she will stand by them and she watches her mental health deteriorate and feels herself disappearing more with each episode she experiences.

We were trying to help by just finding out all of the options.
