Divorce or Annullment, which one?

I'm engaged to a man that was married 8 yrs. ago. After 2 months of his marriage his wife and him seperated and he never saw her again. Turns out they fought and she had him arrested. His first wife was killed in an auto accident just 6 weeks before he married his 2nd wife and he states that mentally he wasn't thinking and married her out of stupidity. So should an annulment be what he files for or should he file for divorce? Mind you, he hasn't seen his wife in 8 yrs.

And this can be proven how? If that worked don't you think everyone would be doing it. Then years from now to get back, the other spouse could say it was? He needs a divorce. No alternative at this point. He has been married for 8 years.

Thanks so much. We just weren't sure. All this legal stuff is confusing. But he's filled out the papers for divorce and thanks to people like you, and the internet, we have the resources to get this done. Thanks again. :)
