What is the name of your state? California (almost 3 yrs of marriage)
Spouse and I are getting a divorce, finally. While we were married he took a large loan to pay credit card debt incurred prior to marriage using my vehicle as collateral. The loan is in his name only, I told him that he needs to pay off the loan, but refuses. He agrees to pay for loan monthly but I am not confident he will if he gets mad about something (towards me) he always tells me he is going to let my vehicle get repo'd. Also why should I let him have this over me, we have no children in this marriage. How can I protect my vehicle in the divorce papers? Is there a way through the courts to have him refinance the loan with a different collateral? I don't want anything else from him, just to be done.
