Divorce malpractice?Florida When reviewing a draft of my final divorce documents, my lawyer mistakenly put that a truck titled to me was to be given to my ex-husband. I asked her to change it, via e-mail, and she told me would, again via e-mail. Unfortunately, I did not check the final papers before she sent them to be signed by the judge and lo and behold she did not change it. Now, the divorce is final and my ex wants his truck. I want my truck (or the money). Is this considered legal malpractice? |

| Your best chance to recover from this error is if the divorce was only recently finalized. If the decree is still within the post judgment plenary period, you might be able to request that the judge correct this. You will need to talk to your attorney to determine whether this approach is a viable option in your case. Last edited by Ronin; 02-22-2009 at 09:34 PM. |
