Hi

I Have a questions for my friend. She want to get a divorce because she has been verbally and physically abused. This marriage has a kid and she wants to have custody. Although, the husband is NOT willing to sign the documents of the divorce, can she still get a divorce? And can she still have custody of the son?

She does not have to get his signature to get a divorced. However, without his signature it becomes a contested divorce. She has at least a 50/50 chance of getting primary custody of the child....maybe better, depending on who has been the primary caretaker of the child.

However, she REALLY needs an attorney.

"Maybe better" or almost certainly better depending on the judge?
