Just wondering how easy it is for a manupulative wife to obtain divorce and subsequently chid custody & child support? What is keeping the judge from deciding in her favor if she does a great acting job in making false accusations against her husband, including verbal abuse and domestic rape charges? Is it considered evidence, if, during the marriage she speaks to a domestic violence counselor, and makes false allegations and uses that as 'documented evidence'?

Also, what if, during marriage, the wife flees out-of-state with the baby (again, falsely stating she is getting away from an abusive husband), and not providing easy telephone access to the husband to find out about the baby - can this be held against her? How long (in months) before she has to return the baby to her home so the husband can see the baby?

What county are you in? I ask this for personal reasons.
I am simply going to use quotes and reply as you have many questions.

Depends on if she has any documented police reports, and you have charges against you.

the ju Is it considered evidence, if, during the marriage she speaks to a domestic violence counselor, and makes false allegations and uses that as 'documented evidence'? Yes, that can be used.

Also, what if, during marriage, the wife flees out-of-state with the baby (again, falsely stating she is getting away from an abusive husband), and not providing easy telephone access to the husband to find out about the baby - can this be held against her? No, this cannot be held against her. At this point you both have the same rights, and nothing she is doing is illegal. File for divorce and that will soon change.

and How long (in months) before she has to return the baby to her home so the husband can see the baby? There is no time limit, you both have equal rights. She is not doing anything illegal, (SAD YES), but not illegial.Y

You need to get to the court house and file for custody/visitation rights PRONTO.Todd[/QUOTE]
