Divorce-Wifes Past debts


What is the name of your state (only U.S. law)? Washington
Wife has served me with divorce papers. In the divorce, she is requesting that I pay off the car that she had before the marriage and in which she had reposessed. Not only that, she is also requesting that I pay off her credit cards which were maxed out before we met due to her beauty shop failing. Can she get away with this? What can I do to fight these charges?

Who is keeping the car? if she is keeping the car, she will probably keep the debt on it - particularly if she purchased it before you were married and her name is on the loan.

The credit cards are not as simple. Let's say the card was maxed out before you were married. Then, during the course of your marriage, you made monthly payments while running up new charges so it was still maxed out at the time of the divorce. She will argue (with some justification) that the payments would have paid off the oldest debt first and that anything charged since the marriage is joint debt.

Some of it also has to do with other assets and debts. If she is offering to let you keep other assets in return for paying off the car, that is a reasonable position, so it's hard to answer your question in isolation.
