Question

Do I have any legal recourse?


What is the name of your state?Arizona
My wife and I have not been living together since 2002. She went back to her home in Alabama. Since I am in the Air Force stationed in Phoenix Arizona, I stayed. Neither one of us filed for divorce. In April of 2004, after I got back from the war, I bought her a new car. I have been paying the payment and insurance $600+ per month. Anytime she needed money I would let her get it, if I had it. We still had a joint account with the agreement that she would not touch it unless she talked to me first. Since we split up in 2002 she stuck to that agreement.
I recently got my re-enlistment bonus from the Air Force. She proceeded to hit several ATM's and withdrawl $500, $200, or what ever the machine would allow until it would not give her anymore. Then go to the next one and do the same thing. In less than 3 days, she had drained the account and put it in the hole $300. At the time, I was in Florida for work training (TDY) and was not aware of what was happening until I went to withdrawl money and saw the negative balance. I realize it was sheer stupidity (I trusted her) not to get a seperate account. She had never done anything like that before and said she never would. What I want to know is since we have been seperated for over 2 yrs, and I have been paying her car payment, insurance and most anything else she has needed, can she legally do that? Do I have any legal recourse?

You gave her a nice gift when you put money in a bank account with her name on it.
