I had seperate residence in joint tenancy w/ my mother when I married in 9/95. New spouse lived with me & my kids in the house during entire marriage. I quitclaimed it to her in 7/1999 in a refinance. New spouse did not sign a quitclaim to me. Seperated in 4/2003 and divorce getting uglier. X-Spouse wants $1600 x 12months x 7 1/2 years to be reimbursed to him. Can he get it?????????

Your post makes very little sense. If you're in a j/t with your mother, how were you able to quitclaim the house to "her" - - the new spouse? And then, you start talking about "him". Which gender do you wish to talk about; i.e., Who are you in this scenario, the wife or the husband?

I think I may have gotten it.

She owned the house in joint tenancy with her mother. She quit claimed the house to her mother in 1999 to facilitate a refinance. Now she and her husband are getting divorced and he is trying to get a share of the house. Apparently a very large share.

My guess is that she can fight him getting anything in regards to the house, but that if he was to get anything it would be only 1/4 of the equity that appreciated during the marriage at best....and perhaps only 1/4 of the equity that appreciated up until she quit claimed her share to her mother.

Unless 1/4 of the equity that appreciated during the marriage is worth 1600.00 x 12 months x 7 1/2 years, I doubt he will get anywhere with that.
