There are differing opinions on that..however in all reality it really doesn't matter.

It mattered in my divorce

Whoever files is the plantiff and sets the rules right off the bat by sending out the summons. I spent the first $1500 for my lawyer disputing allegations and filing a counter-claim. Also in my case, my wife moved to another state (and live there for 6 months), so when she filed the divorce, it was an Arkansas divorce eventhough we live in Mississippi the last 3 years of our marriage. It was a pain to have to drive to Arkansas to hire a lawyer, and do most of the talking back and forth on the phone.
