Does the No-Fault: cohabitation for 1 year applies to members of the Armed Forces?What is the name of your state? VA Does the No-Fault: (1) Living separate and apart without cohabitation for 1 year applies to the members of the Armed Forces? I have been separated from my spouse for 17 months because I decide to go and stay overseas because of our marital problems. We don't have a separation agreement at this moment. What can I do? |

| Technically while stationed overseas, your residence remains stateside, so it is not considered abandonment or non-cohabitaiton, also you should beocme familiar with the SSCRA which allows for delay in legal proceedings while deployed. |
