What is the name of your state (only U.S. law)? Georgia

I want to evict my spouse from my home. The house is in my name only as I purchased the house several years before I married my spouse. My spouse also owns a home in his name only that he purchased before our marriage. He refuses to leave my house and go back to his. We have been married less than a year. Can I have him evicted?

No, you cannot evict him from the marital home (where you both lived together during marriage). You can file for divorce and request sole posession of the home, but the judge may not order him to leave until your divorce is final. It is very likely that you will EVENTUALLY be able to legally remove him from the house, you can't do it yourself or outside of a divorce proceeding.
