My Ex has abandoned the house which we purchased in upstate New York. He was to sell within a specified amount of time as stipulated in the divorce decree. He has had full use of the residence for 4 years. I relocated to Long Island 3 years ago and went there before xmas to view the house & found that not only had he not maintained the property but that he literally destroyed it during that time. He ripped out the kitchen & two of the bathrooms even though he was not to make any repairs over $500 without my written consent. He agreed to meet me there because he wanted me to sign for a second mortgage to make repair & upgrades etc. which I had refused to do. The property was already appraised for $60K over the mortgage in its preexisting condition.

The problem is that my attorney in Syracuse cannot locate him. He was using a PO Box but closed it out & no longer works for the same company. I cannot afford the house & my husband was making 4 years ago over $150 K. He could be anywhere? The Mortgage is in both of our names. How do I protect my credit? And if it is possible to find him what recourse do I have? I have pictures of the damage & a copy of the appraisal. Can I sue him for the apx. $30K in lost income?
