In divorce decree ex-husband agreed to keep joint real estate property and make payments etc. However he is 2 months behind.

Can I take him to court to have the house released to me so I can sell it?

You can ask that the court hold him in contempt for failure to comply with a court order (your decree).

Separately, you can negotiate w/him the issue of the sale of the home.

If he won't agree to that, however, then you can file a petition to partition and get your name off the house. You don't say your name is on the house loan, but I'm making that assumption because you're concerned about the payments not being made.
