I am eligible to retire in April 2005. My exwife and her boyfriend have been living together fulltime maintaining a household since 1996 but she has no plans to marry him until after she turns 55 so that she can still be eligible for survivor benefits on my civil service retirement. She lives in the State of Florida which does not recognize common law marriage. This just doesn't seem fair, nor moral. How can she legally have a right to survivor benefits from my retirement when she has for some time been living in a marital relationship with everything except the license to do so?
