If during a divorce, one party threatens to file contempt of court charges unless $XX,XXX is paid to her monthly, does this constitute extortion and is it criminal?What is the name of your state (only U.S. law)?
No and no. If a party is violating a court order, the other party is free to file for contempt. If they want to offer a settlement in lieu of whatever the court ordered, that is acceptable.
Now, unless there's a valid court order that one party is violating, contempt of court doesn't apply, anyway.
