We live in Pennsylvania. My friend has been going through a divorce for the past 9-1/2 years. The county courts have awarded his spouse 70% of what they consider his assets, including all premarital assets. He also has to pay the long overdue property taxes, legal fees, etc out his 30%. Once he pays her off, he will have nothing left. They were married in 1989 and separated in 1992. He filed an appeal to the Superior Court, however, by the time it gets there 2-4 years from now he will have to claim bankruptcy. My question is how can the courts consider forcing someone into bankruptcy a fair & equitable settlement. And how is a 70/30 split considered fair and "equitable".
