Your post is a little confusing. The first part makes it sound like a divorce has actually been filed in NY, and the second part makes it sound like only paperwork has been drawn up but not actually filed.
If nothing has actually been filed with the courts yet in NY, and your stbx is a legal resident of NJ, your stbx can do that.
