forgery,adultry,theft....help!


What is the name of your state? Ohio

I have filed for divorce and my hearing is in approx. 30 days. My wife left without notice.She loaded a moving truck with over half the belongings of our 19 year marriage and moved to idaho taking our daughter with her. As requested by our daughter, I retrieved her and got temp. custody. My wife at best has contacted her less than 10 times in the past 5 months. Now my wife threatenes me with seeking custody (she wants my money). My wife has had approx. 7 affairs, 3 in the last 7 years. She diverted her payroll checks to another account for 2 months, and also cashed in our childrens mutual funds which my parents werecustodians of (she forged my mothers name to cash them) and also forged my name on the child tax credit check. She still wants alamony (she is skilled and has always worked), and more of the personal property(she left hardly anything). My attorney says I may have to pay alamony, and give up more items. My wife has also recorded our phone calls (without me knowing) and accessed my personal bank account and personal e-mail. Also, she has accused me of drug use, affairs, and fearing for her life because i may kill her (all of this is NOT true, no affairs, no drug use, never even laid a hand on her nor threatened). Do I have anything to fear on my final hearing? I feel left in the dark and dont know what to expect. I just want this darn thing over!!

my wife also accused me (and was the basis for her departure) of having a sexual affair with our exchange student we were hosting. no, i did not, as a matter of fact i wrote her parents to make them aware of the situation. They throughly checked into it (as any parent would) and wrote back saying her charges are false. My wife thinks because half the students diary was in her native language, it was some sort of code (wacko). Man, this thing is a mess, any advice at all??? (please)

[COLOR=royalblue]Well, you have to begin with 30 days before your first hearing. When people accuse others, whether faults or true, it is so child like and so sad an adult will do this. A Judge in the long run will have to decide who to believe. I would only think that you will have to show her character, hopefully with proof in the court room or mediations thru the court. And make sure you are calm and mature in the courts thru this. Maybe you could find credible witness or have records to have some form of proof.

Now you say she has your recorded on the phone in conversation with her without you knowing this, I thought this was illegal!! Have your attorney to not allow this in any hearing. Now, if you have nothing to worry about what is on tape and feel she has shown some of her low profile of character, maybe you would want it heard in court, that you may want to think about.

I have heard people in your situations, that they installed a well hidden camera (without audio, makes this legal) in the house. And had the truth to be known in court.[/COLOR]

Please know I am not an attorney and this is my personal opinion.

A: Ohio is a one party state - she is well within her rights to tape calls. It will be up to the judge whether the tapes are admissible.

Thank you for the responce stealth2 & raisinkid

I would like any input as to what the outcome of my hearing will probally be. I know she will be accusing me of all sorts of stuff, but I am innocent of her charges, and she certently has nothing to back up her charges. I know her biggest threat is me having an affair with our exchange student, but as I indicated, I have a letter from her father saying he checked this out and knows nothing happened. She has always been employed and is skilled and trained in nursing. She is currently residing with her bf.

my questions are
1) will I have to pay alamony?
2) can she use the letters from my current gf that she acquired when she hacked into my e-mail?
3) isnt it WAY illegal to forge my and my mothers name on those checks?
4) how will a judge view how she opened a seperate account and deposited her checks into it without me knowing when we were together.
5) being the custodial parent will I have more rights to keep what is left of our current maritial property. (she wants my tools and guns)
6)how will a judge view her false accusations.
7)she tried to commit suicide about 7 months ago, will this help or hurt me? (took a bunch of sleeping pills) (in the presence of our children)
8)I had to file for bankruptsy, I did on everything in my name, and asked her to fly out to ohio (at my expence) to sign with me so she would not have to pay the fees I did, and to speed along finializing our depts and such. will the judge have me pay for her filing and lawyer costs?

please help...... (thank you in advance)

A: Nope. Custody isn't related to property settlement.

A: Depends if the judge thinks they're false.

A: COuld help, might not make any difference.

A: Impossible to predict. Likely not, but again - anything is possible.

any party could of signed the tax child credit


Just so you know, the tax credit checks from the IRS has both parties name on it, she legally signed her name most likely. She didn't need your signature. She didn't do anything illegal in this matter. Guess she got to the mailbox first.
