Free apartment considered part of income?

What is the name of your state? California

I have been living seperate from my husband for almost 1 1/2 years. He lives free, in the apartment building which his mother owns. He didn't include that as income in his divorce summons to me. Wouldn't that constitute additional income of a sort? Note, that he is the primary bread-earner and will be paying alimony. Please tell me!
