A friend of mine owns the house my husband and I live in. He was gracious enough to take out a home equity loan for my husband and myself so that we could fix the roof and get caught up on our debt. I am a stay at home mom and my husband and myself agreed to payback the loan in full to my friend, it was nice of him to co-sign, plus it has been good for his credit. regretfully, my husband and I are getting a divorce and my husband doesnt feel he has to pay back any of the debt (21 thousand dollars)! and he says he's happy that theh loan is in his name - he wont even pay for 1/2 of the loan and is sticking me with the entire loan. Do I have any rights or is he completely protected that nothing is in his name?
just fyi I can prove that the loan money (30 thousand total) was deposited into our joint checking account, and was spent from there. Im just confused as to what rights I have and wondering if anyone has had similar sittuation.
