House equity


What is the name of your state?Louisiana

My sep. husband is telling me that he is getting a lawyer for divorce & that I'm going to have to give him money for all the things he has done to MY house while we were married. Let me state, that I have all the bills, still in my name, that we used for these improvements. Can he do this? The house was mine before divorce & I have a prenup. Any advice would be helpful.

What does your prenup say about this situation?

It just states that the house, car, savings account which all were mine before marriage will remain mine solely. It doesn't get into any specifics.

Did you use any marital monies to take out a home improvement loan, refinance or otherwise encumber the home?

And how old is this poorly-drawn prenup?

Did hubby have his own separate lawyer when this doc was drawn up?

We used my credit cards, which I still owe on, for any home improvements. He had filed bankruptcy right before we married, so he had nothing in his name. The prenup is 3 years old & it was drawned up by HIS lawyer. It was his idea.

So, what you are saying is that he thinks he deserves a share of the equity due to the physical labor he spent in making home improvements? Not because he actually paid for any of the improvements? He probably won't get far with that argument, but its not possible to fully predict what a judge might order.

I will also tell you that its generally considered to be unwise to listen to any legal information given by an ex or soon to be ex.
