House proceeds in Colorado separation

My husband plans to sell the house we have lived in but has title to and move away. I have contributed to half of all living expenses including half the mortgage since I moved in. We have filed taxes separately and he has taken all the mortgage interest writeoffs for the house in the past. In the event I file for separation, am I eligible for proceeds from the sale of the house since I can prove I paid half the mortgage??

Colorado is not a community property state, however as a generic answer, if the mortgage was paid out of marital assets you are entitled to one half of that contribution as well as one-half of the appreciation of the property. Check with an attorney to make sure you have all of the facts laid out.
