How do I file for annulment?


What is the name of your state?Montana
I have found out that my husband never finalized his divorce from his first wife. Apparently she never filed the paperwork. To my understanding, this makes our marriage fraudulent because at that time I didn't know he was married before [in Oregon] and he answered that he had never been married before when we applied for our marriage license. I am planning to leave him based on emotional abuse. Would you recommend divorce or annulment? Also can you recommend a source for legal assistance for me or explain how I can do this myself? Thanks to my husband, I am completely broke.

Bigamy is a misdemeanor in Montana, but you can have some fun with him along the way after you have your proof. You can do either annulment or divorce, both will include property settlements etc but best to have an attorney handle, making him pay of course. There may be Income tax implications as well, so you should find out about "innocent spouse" laws. Also, if there is any domestic violence be sure to lock up any firearms before serving the papers.

Annulment can be much much more expensive....
