How to file a motion to dismiss in va

What is the name of your state (only U.S. law)? VA
I SIGNED A AGREEMENT WHERE HE SUPPOSED TO FILE A DIVORCE WITH NO FAULT BUT HE FILE IT UNDER CONSTRUCTIVE DESERTION GROUNDS. I WOULD LIKE TO PRESENT A MOTION TO DISMISS THAT? HOW CAN I DO IT? I LIVE IN VA
