How to get a Hearing on TRO


What is the name of your state? WA

My wife filed for divorce in WA (I'm in OR) and asked for a TRO to keep me from seeing our son. The judge placed everything on hold while OR and WA had jurisdictional hearings but the TRO stayed in place. There has never been a hearing on the TRO and I have been able to document the alegations as untrue.

Now, OR has given WA jurisdiction under the "inconvenient forum" rules of the UCCJEA.

I am going Pro Se and my wife has an attorney who she isn't paying.

Her attorney called me yesterday to talk about a settlement and asked me to be patient while they work on one. I have asked them to withdraw the TRO, allow immediate phone calls between my son and myself, and to allow parenting time (weekend this month).

I have a feeling that her attorney is stalling things until he gets paid because he has not responded to my request.

I want to have a hearing on the TRO. How do I go about requesting the hearing? It looks like I need to file a Motion for Docket, call the clerk to get a time/date, and serve her attorney.

Is that all I need to do?

The reason I am going to use for the hearing is that I have not been given due process since there was never a hearing.
