Mother separated with a man years ago. Never married, just engaged. Bought a home together in 2010, however only mother's name is on the deed while both names are on the mortgage. Never really understood why he chose to do this, but that's how it is. Man moved out in 2011 after disagreement. Mother continued to live in home and pay mortgage on her own. Is my mother's previous partner entitled to any proceeds from the sale of the home or is he in any position to force her to sell? They both put an equal amount ~50k into the downpayment when they first purchased the home. Since then my mother has paid the mortgage on her own in the amount of 125k+ in the past few years. She wants to just pay him the downpayment he gave towards the home, however he is demanding that he pay her more than 3x that amount based on the fact that the apartment is worth around 1.5 million dollars and after paying the amount remaining on the mortgage + all fees etc he should be entitled to some of the proceeds if it were sold.
