What is the name of your state? Georgia

My friend and her husband are separated. Not legally separated at this point, but he left the home approximately 2 weeks ago. They have been married for 7 years and have a 6 year old child together.

My question is this: My friend has not worked in almost a year, and they only had one vehicle. Her husband was financially abusive during their marriage, telling her it was his money, not giving her money for groceries, clothing, etc. He took the car when he left, and now she has no way to go out and get a job, and is relying on relatives to get her daughter to and from school.

Is it legal for him to leave her with no transportation, no money, etc. even though they both want a divorce?

Is it legal? Is it his car or is it jointly owned? He cannot be stopped from moving legally, as a judge will not order him to move back in. She needs to get a divorce attorney.

thanks

Hi, and thank you for posting a response.

It is his car...he bought it and did not put her name on the title.
I know that he can move out if he wants, but isn't he leaving their child in a state of need, i.e. no money for food, no transportation to school? Is that considered abandonment of his child?

I have heard that in some states it is illegal for a spouse to leave their spouse with no transportation. Do you know if that is true?

We're in GA.

Thanks again
