Husband wont agree to divorce


What is the name of your state?What is the name of your state? Indiana
My husband just up and left me and his three daughters one day and moved to Georgia. He refuses to give me an address and refuses to see his three kids, two of which are physically and mentally handicapped twins. The twins are 18 months and my third child is 3 years old. He refuses to help in anyway. He also has two more daughters by two different women, which he doesn't pay child support as he should for them either. I have gone to Legal Aid to assist with my divorce. They have told me that I have to get "HIS" address in Georgia in order to send the divorce papers to get him to sign them. Legal Aid said that I cannot use his parents address here in Indiana to send the papers. I have contacted him and informed him that I really need his address so that he can agree to this divorce and so that we can get this over with. He will not give it to me. I believe he is refusing to give it to me because he is just trying to avoid paying child support. Maybe he thinks that if no one can find him, then he doesn't have to be responsible for anything. My question is - how can I get a divorce from this man when I dont know where he is. I want to move on with my life! Please help. Thank you.

You don't need his signature to get a divorce. You can also have him served via publication if he won't give you his address. Talk to legal aid again about this. Tell them he specifically refuses to give you an address so that he can be served and that he won't sign any paperwork. Ask them about service via publication and a divorce without his signature.

If service via publication doesn't work, you can go to different web sites that offer free searches to try and locate his address. Yellow pages or white pages for example may turn up a few names that will at least give you some sort of idea on where to start tracking him down.

I have spoken to my lawyer about the publication of divorce and basically it will cost me about $100 to do this. I dont have the money to do this. Is there free ways of getting this done?

No, there isn't. Service by publication requires putting an ad in a publication...that costs money.

If you can find the town he's in by using the reverse directory you can place the notice in that town's "local" newspaper (or a paper with a larger circulation area). It shouldn't cost $100, but if it needs to be posted for 30 days it might cost $20+. You don't have much other choice. Even if you fill out and file the papers yourself there will be some fees. Surely yoiu can scrape up $100 to do all this. Then you send the court system after him for support.

And, castration!

I hate to tell you this but even in a small town newspaper I doubt that $20 would cover it for 30 days.

Thinking about the length that might be required for the notice you are probably right. Maybe $50 will do it, but this girl needs to beg or borrow it if necessary.

Where do these guys crawl out from?
