Hypothetical on Social Security and Divorce What is the name of your state? NJ
Please pardon the generics on this -- I am asking on a friend's behalf.
Man and Woman meet in the 1960s. They marry in 1972. It is subsequently discovered that Man is still legally married to another; divorce is not final until 1979. Man and Woman never remarry and "divorce" in 1987. Woman dies in 1997. Would Man be entitled to draw on Woman's Social Security benefits, now that he has reached retirement age? If not, what can happen to him if he's already receiving benefits? |
