When my wife and I divorce, I will want to keep the house. How will that work?Do I refinance and give her half of the equity?

The answer will depend on several factors:

1. Whose name is on the deed?
2. Whose name is on the mortgage?
3. When was the home purchased?
4. When was your marriage?
5. What was the source of funds for the downpayment?
6. Have you been paying the mortgage and upkeep out of marital funds?
7. Is the home equity greater than when you were married (or when you bought it - whichever is later)?
