What is the name of your state (only U.S. law)? California

I was served with papers to appear in court for Contempt Charges. I'm not worried about the contempt charges however, I'm concerned about the serving.

In the papers (OSC and Affidavit for Contempt) my ex checked the box 8E (I'm requesting that attorney fees and court costs be rewarded....) and then it says that a copy of their Income and Expense Declaration is attached - which it wasn't.

Because my ex didn't attach their I & E, is the serving still proper? If not, is there case law that you can send me to prove my case?
