Inheritance


My wife is divorcing me... My parents died after we were married nand left me a substantial amount of money. We used some of this money as a down payment on a house. When we sell the house, is she entitled to any of the equity and profit from the sale?

In Indiana, she would probably be entitled to half the equity in the house, because that money would be considered comingled.

However, if you kept the rest in a separate account, without her name on it, then the rest would probably be considered your sole property.

Of course, things might be different in your top-secret state.

IAAL.... I'm back with another question. My wife and I talked that after the sale of the house, we would relieve ourselves of all debt, then divide the remainder. She informed me that
the "debt" to be paid off does not included our auto loans. She thinks we should be responsible for our own vehicles. I believe the payoff amount of each auto should be part of the "debt relief".
She disagrees... The payoff on her car is $2,400.00 The payoff on my car is $13,400.00 Obviously she comes out ahead by doing things her way. Why shouldn't the auto loans be considered to be paid off. Do I, with the aid of an attorney, compile all of our debt, and have ALL debt paid off through the court? That way our auto loans are paid off by order of the court. I think that if I present the idea with the intentions of wanting to make sure all debts are paid the court would handle it.

Please let me know...

Well honey, welcome back today. doesn't look like you have a dumb one on your hands. Seems she knows how to protect her butt when it's in a sling. This is when you use the "tact" and "charm" abilities. She could get it her way. However this is when you sit her down and gently pursuade her to see it your way. You know what tact is right? It's the ability to tell someone to go to hell and have them be happy to be on their way. Point out that if all debts are paid it could benefit your children by having two parents financially stable where as if you were paying off your own loan you would be strapped between that and possible child support(could be the same for her) and the children would obtain less from you for you have less funds to spend. "However, dear, we would have the money to pay off ALL debt with the sale of the house and the children would be able to still have the same lifestyle they do now" If she doesn't agree sounds as if you'll hash it out in court. Good luck and hopefully IAAL will respond.

Once again...Good idea. I think that I'll try that approach first. I believe I can persuade her to see the benefits to paying off the vehicles. I used to sell cars, so I can sell an idea when needed.
I'm not proud of my previous career, so no sleezy salesman jokes.

If not... Can I get an arrangment to get ALL debt paid off thru the court?

You can try but that doesn't mean you'll win. Who is actually filing the divorce? Seems that usually the one who files has a better chance of getting their way. I personally think it makes more sense to do it your way but I also see where she's coming from.

No salesmen jokes here for I've been told I can talk my way out of anything and then of course I have the extra gene that God gave women. That's the sneaky gene. I know how to screw someone and they never even know they've been screwed. Fact of the matter is I don't lie about it either. I can't, I feel too guilty even if I try and I'll rat myself out.

Here's some advice on how to go about it. Seem sypathetic about her side of it. Even if you don't understand her reasoning pretend you do..HEE HEE but make her see your side and use what you have to.

Come back if you need more advice on how women think and how to actually work us. But SHHHHHHHHHHHHHH..... it's a trade secret and I could be executed for giving out my knowledge and making someone of the male species aware....

She's the one filing... I'll try and talk to her first and see where that gets me. I understand she needs all she can get to make a fresh new start for the kids. I too though need all I can get to start a new life. Hopefully she'll understand.

Thanks for the trade secret!!! I needed that secret about 6 months ago!!!!! HA! HA!

Sneaky gene huh?? Are you sure that's the only advantage you girls have over us??

What are you trying to say??? You mean we have other advantages??? HUM!!! Watch out for the tears...that either indicates she's messing with her head... well either way her heads being messed with... either she's trying to pull one over on you or she's ticked off enough that the horns will appear. I've made more then one grown man cry. This is when you run as fast as you can in the other direction and your only recourse is to simply shake your head and say "yes dear." Then you have to either eat crow or think of another solution cuz that one obviously isn't working. The thing through all this that BOTH of you MUST keep in mind are the children and petty fighting back and forth doesn't benefit them. Show the children that divorce isn't as devestating as all the rumors if it's done right.

Agreed. The kids well being is the most important issue. I want this to run its course as smoothly as possible. I just don't want to get screwed in the process.

Where the hell is IAAL?? Must be on the golf course.....
