What is the name of your state (only U.S. law)? New Mexico
My wife and I are filing an uncontested dissolution petition and the form asks the following question regarding retirement benefits..... The petitioner shall (check one)____ waive(___pay over) in favor of respondent____% of all present and future claims to any and all accrued retirement benefits due from: name of employer, etc. Neither of us wants to receive any retirement funds from the other and am I correct to assume that we each should check the "waive" box and put "zero" in the % box? Thank you!

If you are going to waive all of it, then you need to put 100%.

If you want to pay over some of it, then you need to put whatever percentage you wish.
