Kid gone can I wait until May?

What is the name of your state?

So my wench of a wife left with the child, she took all of her items and kids items. My mom can loan me about 1,500 in May from her tax return. Since she's in another state can I wait until May then file for her to return and see my kid?

I was thinking I would go to see her in Feb for her bday but her bday and my bday are in the same week and my buds are throwing a big party, so i cancelled. Now the wife says that will be held against me too. Is that right?

On the off chance that you are really real, then yes, if you blow off visiting your child on her birthday, in favor of having a party with your buddies, its not going to look particularly good for you.

If you also wait until may to file, its not going to look particularly good for you either.

You might want to take a hard look at your priorities. Tell your "buds" that you want to be with your daughter on her birthday, and that they can throw you a party some other time.

But funnily enough, she was good enough to marry and have a child with!

Wow - it takes 'til May to get a tax refund in your part of the world? Even if I wait until April 15th to file, I have mine w/in 10 days.

Of course, you could ask your buds to skip the bash and give you the money they'd have spent so you could file earlier. Naaaah.... party's more fun.

And if you are for real, and if you gave a darn, you'd have grabbed every extra job you could get your hands on and worked your backside off every day since she left with your kid to get all the money you need to drag your butt to an attorney and file to get your kid BACK to your town.. You would NOT wait for Mommy's money. AND, IF YOUR WERE for real, you'd use any legal means to be with your kid on her birthday, and tell your buds their party can wait till you get back.

I worked two jobs for years just to save up to get to be a parent. Parents who CARE do what it takes to fight to have their child with them.

Oh, yeah, Einstein, you quoted me but answered Stealth.

I file in April and through the MAIL it takes 6 weeks and that is what my mom does too. I don't have money of my own because I DON'T WORK. WEll I work 2-3 days a week. I don't like to work for others. I'm not your mexican a$$ worker ya know.

Regardless she left without a court order.
We were discussing another poster , NOT YOU . You might receive more help if your original post didn't make you sound so pathetic . Refering to your STBX as a wench and YOUR child as " the kid " doesn't exactly make you a sympathetic figure .

I'm not surprised that she left. How about getting a job, buckaroo? Oh yeah, you don't like to work for others, so you don't work and leech off Mommy instead. That'll play out nicely for you when the judge orders you to pay child support. 'Cause you WILL be paying support - it's unlikely you'll get custody of "the kid". Mom's actually allowed to remove the child from the state since there's no court order. And by the time May rolls around, she'll likely be a resident of the other state and can file there.

You're quite the rocket scientist, aren't ya?

I don't for a minute believe that your mom is dumb enough to file in april (when she is due a refund).

It used to take 6 weeks to get a refund if you filed a paper return...these days it takes about 4 weeks.

Anybody can file an electronic return and get a refund in less than three weeks...and often in less than two...and anyone who is desparate for their refund can get it guaranteed within 10 days to 2 weeks through a professional preparer...and if they qualify within 24 - 48 hours (which probably wouldn't be the case for your mother since she habitually files a paper return).

Even if your mom insists on filing a paper return she would get her refund in mid march at the worst if she files promptly...and that's a worst case....the beginning of march is more likely.

Your wife didn't need a court order to leave with the kids. You need a court order to make her come back....and the longer she is there, the less likely you will be to get a court order to make her come back.

If you don't plan on working to help support your child, what in the hell makes you think that a judge would make mom bring the child back?

I looked up this profile and this dumb wench sounds just as sick as my wife.

Look I make about $280 a week. I said May because my MOM said May I could borrow the money I don't know about her dumb refunds and all that, it's what she told me.

My wife has a job out there set up already and my kid's in daycare I don't like that. I thought the courts job is the KEEP FAMILIES TOGETHER. She left and now our family is not together and now I am going to have to pay rent in this house without her money she used to get from babysitting from time to time. Nobody cares about me the FATHER.

Are you referring to father's in general or specifically? YOU If you are referring to the former, you are WRONG. If you are referring to yourself, you are right, no one cares. But it has NOTHING to do with the fact that you just happen to be a father. It's because you are an ignorant jackass.
