If Legal Separation papers are drawn up, and the Legal Separation benefits the children in the relationship because the Separation would bring the children closer to there family since all of the family lives in another state, but the husband in the relationship does not want to sign the papers can the wife and children still leave the state legally?

Yes, they could. However, the husband could easily march to court and ask a judge to order mom to return the children to the original home state, and a judge might very well make that order.

Mom needs either dad's permission or the permission of the courts to relocate the children if she wants to be certain not to have any reprecussions.

So you think it benefits the children to be torn away from their father?

Good thing the courts don't agree with that selfish one-sided view. Ldij's response was right.

ALL of the family? Their father IS one of the MOST important family members there is! How can "all of the family" be in another state when their own father is not? The relationship with their parents is the single most omprtant familial relationship for children.
