What is the name of your state (only U.S. law)? Wisconsin
If I file for a legal separation from my husband of 5 years and he has had two DUI's in the last 4 years and he drives drunk and injures or kills someone, can the injured party or families come after my home or sue me if we are legally separated? I have lived in my home for 16 years and he is not on the mortgage or deed to my home.

Whose car would he be driving? Whose insurance?

Why aren't you simply filing for divorce? As OG stated if he is driving a car that has your name associated with it or your insurance associated with it you have a serious problem.

Get divorced and get your name disassociated with him asap.

He has moved out already and he is driving his car in his name with insurance in his name only.
