What is the name of your state (only U.S. law)? Oregon

I have a friend who has become legally sperated from his wife, and is not living in the same household anymore. They have started with legal seperation, only due to medial benefits, but plan to divorce as soon as the medical issue is resolved. Durring this leagal seperation, is he allowed to date outside his marrigae, with his wifes knowledge, without her being able to later us it as a "fault" divorce for adultery?

This varies a great deal from state to state, so here's some advice from an OR attorney:

Bottom line is that a 'serious' relationship is usually a bad idea until the divorce is finalized, particularly if the kids are exposed to the bf/gf. It's not illegal, just not a good idea.

Sure he can date.

And sure, she can try to use it against him later. With that said, it usually isn't an issue unless custody and spousal support are issues. Oregon sometimes considers adultery as a factor in deciding spousal support and very occasionally in custody decisions.

He'd be far better advised to be a good boy until the divorce is over.
