legal seperation rightsWhat is the name of your state? North Carolina************** I have been legally seperated for 10 yrs now. What are my legal rights as a spouse(such as inheritance, his s.s.benefits, life insurance, home etc....) should my husband die. Would I receive this?? or does the state consider me legally divorced after so many years??? Also, he has been trying to get me health insurance through his work...and cant b/c we are not living together???? Is that legal for the insurance co. to do???? please advise thanks!!!! |

| Why on earth have you been legally seperated for ten years????? If you guys cannot work through your differences now what makes you think you will. You need to get a divorce from him and go on with your life. The only way you will get insurance and such is if you are listed as beneficay.If his inhertience is family inhertence then I am sure his family will step in before they let you have it. As far as insurance goes I have no idea but why not provide your own health insurance? |

| summer1 Are you using the term 'legally separated' in its true definition for NC? If so, then you have been granted a 'divorce from bed and board' and are not going to automatically receive anything. If he still has you as beneficiary on his life insurance, then you will receive that, but you do not qualify for his pensions or his retirement benefits from Social Security, just as you are not responsible for his liabilities or vice versa. The divorce from bed and board settled these issues. In the same way, you are not his wife as far as insurance purposes go; and, if you move back in to get insurance benefits, then your legal separation ends, and you're back to being married. Unless one of you, or either attorney, had the divorce finalized after one year of being separated, the divorce is not final or is it considered final just because it's been 10 years. |
