What is the name of your state?Florida,My friend is getting divorced,there is some question as to whether or not the home he and wife lived in is marital or pre-marital.She owned it before marriage,but he helped pay mort.for 4 yrs. His name is on mort, but not deed.If he doesnt get an atty.(she's filing)does anyone look over the decree (like judge signing)to be sure assets are divided fairly.He is going by her word that house is not in anyway his.Also ,are all credit cards marital,even if only one name is on it.Thanks No children.

The house is not his, although he may be entitled to some share of the quity that accrued during the marriage. The credit cards belong to the person whose name is on them, but the other spouse may be responsible for a share of the debt that accrued during the marriage.

No, the judge isn't going to make sure that everything is fair, unless its contested and the judge is asked to decide.

Both of them need attorneys. Your friend in particular because his name is on the mortgage. He needs an attorney to ensure that his ex has to refinance the house to get his name off the mortgage.
