    Marital Community

    TEXAS
    According to Texas law (statute if available), does marital community (i.e. community property) end when spouses permanently separate even though there is no formal agreement? Also, can the financial support provided during the separation (before divorce) be deducted on income taxes?

    It has to be a legal separation to end community property. It has to be court ordered alimony/spousal support to be tax deductible.

    There's no such thing as a legal seperation in Texas. They would not be considered seperate until one of the mfiled for a divorce.
