Question

This is a great information base and I really appreciate the internet!

Another question here, on our Stipulated judgment of the dissolution of my marriage, it states for CUSTODY AND VISITATION: it is agreed the legal and physical custody of the minor children shall be shared jointly between the parties, with my ex as primary custodial parent. All visitation periods shall be negotiated between the parties{ holidays ect...}. In the event that the parties cannot agree, the matter will be mediated with notice to the other party without referral from the court.

now does this mean she has the right to change visitation to me here cause of personal differences or her not thinking its safe here for our children or my social life. I posted yesterday with a question about this and got some great advice. Just am wanting to dive deeper into it.

My Ex has told me that if we want we can go to court and she's threatening that she will win and get full custidy of my children and leave the state. Can she do this? Our Devorce basicially states that we share everything. Custody and Expenses, she of course is in a better finiancal cituation and was the person that left me. So I'm feeling like that bad person all the time no mater what I do. I can't aford lawyers or even health insurance for myself right now so I feel helpless.

any advice you can give me is soooo appricated!

My response:

File for Mediation, like the orders tell you to do. If you cannot afford the filing fees, ask the clerk for the Fee Waiver forms. If your finances qualify under the guidelines, your court fees will be waived.

Good luck.
