In Arizona, if one of the parties in a divorce willingly signs a 'stop claim deed' to a property can they be removed as a responsible party on a mortgage during a divorce? More specifically, the house has been owned by my family for over 50 years and to help my wife and I pay off debts my father allowed us to use his home to consolidate bills. Both of our names are now on the deed and mortgage, but I am willing to take over the complete payment on the house. If she files a stop claim deed and we send it into the mortgage company will that free her from responsibility?
