Motion to Vacate


What is the name of your state?IL I married a man from Senegal in Sept 2002, this past March he filed for a divorce citing abandonment as the grounds and the notice was by publication because he stated that my whereabouts were
unknown. On the day that he got a judgement, I found out what he was up to and filed a motion to vacate the judgement. Now, he was served with the notice of the motion to vacate on the same day but he has since gotten married to the woman who signed the affidavit for service swearing that my husband was unable to locate me and that my last known address was unknown to either of them. Unfortunately for the two of them it can be proven that all of the statements that were made in the divorce petition were false and intentionally made. How often is a dissolution judgement vacated and should he have gotten married knowing about the motion?

Why did you file a motion to vacate the judgement? Did you not want to get divorced or did you have a problem with the terms of the divorce?

No, he shouldn't have gotten married knowing about the motion to vacate.

Motion to Vacate


No, I did not want the divorce nor do I agree with the grounds that he used to get the divorce. He claimed adbandonment on my part and stated that I had left the home and was unable to be located. All of the statements made in the petition for dissolution were false and made with the intent to get a divorce on those grounds hoping to make it possible for him to get his immigration papers. My main concern with that is that since I was the person who sponsored him and with him claiming that I abandoned him it leaves me open for legal action from the INS which worries me.
